Photoboto.com Commercial License

This Commercial License ("License") is a legal agreement between you ("Licensee") and Photoboto.com ("Licensor") governing the use of Photoshop actions, Photoshop templates, and photo overlays ("Licensed Assets") purchased or downloaded from Photoboto.com.

By purchasing, downloading, or using any Licensed Assets from Photoboto.com, you agree to the terms and conditions of this License. If you do not agree, do not use the Licensed Assets.

1. Permitted Uses

Licensee is granted a non-exclusive, non-transferable, worldwide license to use the Licensed Assets for the following permitted purposes:

1.1 Commercial Use: The Licensed Assets may be used for commercial projects, including but not limited to:

• Client projects (such as photo edits, branding materials, and advertising)
• Marketing, promotional materials, and social media posts
• Website designs, digital products, and physical products
• Business branding, including logos, brochures, and banners

1.2 Unlimited Personal and Client Projects: Licensee may use the Licensed Assets for an unlimited number of personal and client projects, provided that each project adheres to the terms of this License.

1.3 Modification Allowed: The Licensee may modify the Licensed Assets to suit their project needs, but the licensor retains all rights to the original Licensed Assets.

2. Restrictions

Licensee may not:

2.1 Resell or Redistribute: Resell, sublicense, share, distribute, or make the Licensed Assets available in any form (including free downloads, stock marketplaces, or similar platforms).

2.2 Use in End Products for Sale Without Modification: Use the Licensed Assets in their original form in digital or physical products for resale, such as stock photography, templates, or digital downloads.

2.3 Claim Ownership: Claim ownership of the Licensed Assets, even if they have been modified.

2.4 Use in Trademark or Logo Registrations: The Licensed Assets may be used in a trademark, service mark, or logo where they are the primary visual element.

3. Attribution

Attribution is not required for commercial use but is appreciated when possible.

4. Copyright & Ownership

All Licensed Assets remain the intellectual property of Photoboto.com. Licensee is purchasing a right to use the Licensed Assets, not ownership of the files.

5. Termination

This License is effective until terminated. If Licensee violates any terms of this License, the License is automatically revoked, and the Licensee must immediately cease all use of the Licensed Assets.

6. Warranty & Liability

The Licensed Assets are provided "as is," without warranty of any kind. Licensor is not liable for any damages arising from the use or inability to use the Licensed Assets.

7. Governing Law

This License is governed by the laws of Delaware, United States.
